Terms of Service
In short:
- Drafting and saving patterns is free. Pro (exports and grading) is a subscription you can cancel at any time.
- The patterns you draft are yours to use, sew and sell.
- Blocks are starting points. Always sew a toile before cutting good fabric.
- Consumers in the EU have a 14-day right of withdrawal, explained in section 6.
The full terms below are what applies. Where they and this summary differ, the full terms win.
1Who we are
Pattern Index (the “Service”) at patternindex.app is operated by:
David ZacekCompany ID (IČO): 17396557
Prusanecka 479/2, 155 21 Prague, Czech Republic
Registered in the Trade Register (živnostenský rejstřík)
Email: [email protected]
“We”, “us” and “our” mean the operator above. “You” means the person or business using the Service.
2The Service
The Service is an online tool for drafting made-to-measure garment pattern blocks from body measurements, checking them, grading them into size runs and exporting them.
- Free plan: drafting of all blocks, fit checks, editing lines, and saving patterns to your account.
- Pro plan: everything in Free, plus every export (PDF A4, A3, A0, plotter PDF, SVG, DXF), project files and size grading.
We may improve, add or change features. If we remove a core feature of Pro during a period you have paid for, you may cancel and we will refund the unused part of that period.
3Your account
You need an account to save patterns or subscribe to Pro. You must be at least 16 years old, or use the Service on behalf of a business. Give us a working email address and keep your password to yourself. You are responsible for what happens under your account. Tell us at once at [email protected] if you think someone else has used it.
If you are a business, the person creating the account confirms they may bind that business to these terms.
4Pro subscription and payment
- Prices: the prices shown at checkout are final. For consumers they include VAT where it applies. Business customers may be charged VAT according to their location and VAT status.
- Payment: payments are processed by Stripe. We never see or store your full card number.
- Renewal: Pro renews automatically at the end of each monthly or yearly period, and the price is charged to your payment method, until you cancel.
- Cancelling: cancel any time from your account menu (Manage subscription). Pro stays active until the end of the period you have paid for and does not renew after that. Except as set out in sections 2, 6 and 11, we do not refund partly used periods.
- Failed payments: if a renewal payment fails, Stripe retries it. If it still fails, your account returns to the Free plan. Your saved patterns are kept.
- Price changes: we will tell you about a price change by email at least 30 days before it applies to your next renewal. You may cancel before it takes effect.
- Invoices: receipts and invoices are available in the subscription portal.
5Your patterns and our software
Your work. Patterns, measurements and files you create with the Service belong to you. You may use them for any purpose, including commercial production and selling garments or patterns made from them.
Our software. The Service itself, its code, drafting methods, design and brand belong to us or our licensors. We give you a personal, non-exclusive, non-transferable right to use the Service under these terms. You may not copy, resell or reverse-engineer the Service, bypass the Pro plan, or use automated means to extract its drafting rules.
Storing your data. So that we can save and show your patterns, you allow us to store and process them for the sole purpose of running the Service. See the Privacy Policy.
6Right of withdrawal for consumers
If you are a consumer (a person not acting for a business), you may withdraw from a Pro subscription within 14 days of the day you took it out, without giving a reason.
Immediate start. When you subscribe you ask us to start Pro straight away, during the withdrawal period. If you then withdraw, we refund what you paid minus a proportionate amount for the days you had Pro before telling us, as allowed by Section 1834 of the Czech Civil Code.
How to withdraw. Send a clear statement to [email protected] or by post to the address in section 1, within the 14 days. You may use the form below, but you do not have to. We confirm receipt, cancel the subscription and refund you within 14 days, using the same payment method.
Model withdrawal form
To: David Zacek, Prusanecka 479/2, 155 21 Prague, Czech Republic, [email protected]
I hereby withdraw from my contract for the Pattern Index Pro subscription.
Subscribed on: ____ · Account email: ____ · Name: ____ · Date: ____
7Use the patterns with care
The blocks are drafted by formula from the measurements you enter. Bodies, fabrics and making methods vary, so a block is a starting point, not a guarantee of fit. Check the measurements, print at 100% and check the test square, and sew a toile before cutting your final fabric.
We are not responsible for fabric, labour or production costs caused by wrong measurements, wrong print scale, or the choice to cut without a toile.
8Acceptable use
Do not use the Service to break the law, to upload anything harmful, to attack or overload it, to access other users’ data, or to share your account so that several people use one Pro subscription. We may suspend an account that does so, after warning you where reasonable.
9Availability
We aim to keep the Service running at all times but cannot promise it will be free of interruptions or errors. We may pause it for maintenance. Keep your own copies of important exports.
10Liability
Nothing in these terms limits liability that cannot be limited by law, including liability for harm caused intentionally or by gross negligence, for injury to health, or your statutory rights as a consumer.
Otherwise, for business customers our total liability for all claims in any 12 months is limited to the amount you paid us in those 12 months, and we are not liable for lost profit or indirect loss.
11Complaints about defects
If the Service or an export does not work as described, write to [email protected] with a short description and, if you can, the file or a screenshot. We will reply and settle the complaint without undue delay and within 30 days. Consumers have the rights for defective digital content and services under Sections 2389a to 2389r of the Czech Civil Code, including correction, a price reduction or withdrawal.
12Ending the contract
You may stop using the Service and delete your account at any time by writing to us (a delete button in the app will follow). We delete your patterns as described in the Privacy Policy. We may end the contract for serious or repeated breach of these terms. If we end it without such a breach, we refund any prepaid, unused Pro period.
13Out-of-court dispute resolution
If you are a consumer and we cannot settle a dispute together, you may turn to the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, adr.coi.cz, which handles out-of-court resolution of consumer disputes.
14Law and changes to these terms
These terms are governed by Czech law. If you are a consumer living in another EU country, you keep the protection of the mandatory rules of that country. Courts in the Czech Republic have jurisdiction, without limiting a consumer’s right to sue at home.
We may update these terms, for example when we add features or the law changes. We will email account holders at least 30 days before a change that affects them. If you do not agree, you may cancel before the change takes effect. The version in force always shows its date at the top of this page.
